David Kramer, an attorney with Wilson Sonsini Goodrich & Rosati in Palo Alto, Calif., noted that the amount of spam has continued to climb despite the fact that ISPs have been successfully suing spammers for eight years.

"They're undefeated. Spammers never win these cases," Kramer said. "[Can-Spam] is another arrow in a quiver that was amply full already."

Critics of the law contended that despite the incremental benefits Can-Spam may provide to ISPs, the net effect of the legislation may have the unintended effect of encouraging more spam. This is because the law prevents individual consumers from suing spammers, preempting several state laws that gave individual e-mail recipients that right.

Kramer said that letting people sue spammers would "create an army of enforcement."
